1. Return, Refund, and Cancellation Policy

1.1 Scope

This policy applies to purchases made through maudebergeron.com. Products and services offered may include books, physical products, ebooks, audio downloads, workshops, conferences, events, and retreats.

This policy is in addition to the rights available to you under applicable laws. Nothing in this policy is intended to limit or exclude any right that cannot legally be waived.

1.2 Physical Products

Physical products are final sale and are non-refundable and non-returnable in the event of a change of mind, subject to any rights provided by law.

An exception applies when a product is lost or damaged during transit, or when an incident attributable to the carrier affects delivery. In such circumstances, please contact us at info@maudebergeron.com as soon as possible so that we can open or assist with a claim with the carrier.

• Reasonable evidence may be requested, including photographs of the item, packaging, and shipping label, as well as an accurate description of the circumstances.
  
• In the event of loss, oversight, incorrect delivery, or another shipping-related incident, we may request the information necessary to trace the shipment and document the claim.
  
• The appropriate resolution will depend on the circumstances, the carrier’s findings, and the rights provided by law. This may include a replacement or refund where required.

This final sale policy does not limit any legal warranties or other mandatory remedies available under applicable laws.

1.3 Damaged or Defective Products and Order Errors

Please inspect your order upon receipt. If an item is defective, damaged, or different from the item ordered, please contact us as soon as reasonably possible at info@maudebergeron.com with your order number and, where relevant, photographs of the product and packaging.

We will assess the situation and, depending on the circumstances and applicable rights, offer an appropriate resolution, which may include a replacement, repair, credit, or refund. Rights provided under applicable legal warranties remain unchanged.

1.4 Digital Products and Downloads

Ebooks, audio files, and other digital products are final sale and are non-exchangeable and non-refundable once the content has been delivered, downloaded, or made accessible, subject to any rights provided by law.

The purchase of a digital product grants you only a personal, limited, non-exclusive, and non-transferable right to use the content. Any reproduction, copying, redistribution, dissemination, publication, making available, resale, or commercial use, in whole or in part, is strictly prohibited without the prior written authorization of Maude Bergeron, subject to any exceptions provided by law.

If a technical issue prevents you from accessing purchased content, please contact us at info@maudebergeron.com. We will first attempt to restore access or provide you with a functional copy of the product.

1.5 Conferences and Events

A deposit equal to 20% of the total anticipated booking amount is required to reserve the date of a conference or event. The date is considered reserved only once the deposit has been received and the booking terms have been confirmed.

• Cancellation by the client 60 days or more before the activity: Where reasonably possible and in good faith, we will attempt to agree on a new date, provided that rescheduling does not result in additional fees or expenses. If rescheduling is not possible, the initial deposit remains non-refundable. Venue rental fees and any other expenses already incurred specifically for the event that cannot be recovered remain the responsibility of the client. A separate invoice may be issued, where applicable. If the event has already been paid in full, the remaining balance after deduction of the deposit and any non-recoverable expenses will be refunded. Expenses that have not yet been incurred will not be charged.
• Cancellation between 16 and 59 days before the activity: Unless otherwise agreed in writing, the deposit remains non-refundable, and any expenses already incurred and non-recoverable remain the responsibility of the client. Where possible without additional fees, a new date may be considered in good faith.
• Cancellation 15 days or less before the activity: All amounts due for the booking are payable and non-refundable, subject to any mandatory rights provided by law.
• Cancellation by Maude Bergeron: In the event of illness, force majeure, or another serious circumstance preventing the activity from taking place, we will first attempt to agree on a new date in order to avoid a complete cancellation. If rescheduling is not possible and the nature of the event allows it, we may propose a qualified replacement, with the client’s consent where required. If no new date or acceptable replacement can be arranged, any unpaid fees will not be charged, and amounts already paid for the cancelled service, including the deposit, will be refunded.

Any content, document, presentation, exercise, visual material, recording, method, or other material provided or created by Maude Bergeron remains protected by applicable intellectual property rights. Unless written authorization is provided, such material may not be reproduced, recorded, distributed, shared, resold, or used for commercial purposes.

These terms apply subject to any rights that the parties cannot waive under applicable laws.

1.6 Retreats, Workshops, Meditation Sessions, and Yoga Classes

Each retreat may have a different structure, destination, service providers, inclusions, and financial commitments. Each retreat is therefore subject to specific terms or a separate agreement. The applicable registration, deposit, payment, cancellation, refund, transfer, accommodation, and participation terms are those communicated for the specific retreat and accepted at the time of booking.

Workshops, meditation sessions, and yoga classes may also be subject to specific terms communicated before registration.

Participation in a retreat, workshop, meditation session, yoga class, or any other activity offered by Maude Bergeron is based on each participant’s personal choice. Certain activities may involve physical exertion, movement, periods of silence, breathing exercises, meditation, introspection, or other experiences that may cause physical or emotional discomfort.

Each participant remains responsible for assessing their ability to participate in the activity, respecting their own limits, and refraining from any movement, exercise, or practice they consider inappropriate or unsafe for them. Participants are encouraged to stop an activity if they experience pain, discomfort, dizziness, distress, or any other concerning symptoms and to seek appropriate assistance when necessary.

Participants are responsible for informing Maude Bergeron, before or during the activity where relevant, of any accommodation needs, limitations, or adjustments they wish to disclose so that reasonable accommodations may be considered. However, Maude Bergeron cannot guarantee that every activity or venue can be adapted to every situation.

Participants are responsible for obtaining advice from a qualified professional before participating where their circumstances warrant it. The activities offered do not constitute a medical or psychological assessment and are not a substitute for the care or recommendations of a healthcare professional.

Participants are also responsible for their personal belongings and for complying with safety instructions, venue rules, schedules, and reasonable directions communicated in connection with the activity.

Nothing in this section is intended to exclude or limit any liability that cannot legally be excluded or limited, including liability for bodily or moral injury where prohibited by law.

1.7 Refunds

When a refund is approved, it is generally issued using the original payment method. The time required for the refund to appear in your account will then depend on your financial institution or payment provider. We will notify you once the refund has been processed.

1.8 Promotions and Discounted Items

A promotion or price reduction does not remove any rights granted to consumers by law. Where we voluntarily offer returns for a change of mind, certain promotions or final sale items may nevertheless be excluded if this condition is clearly disclosed before purchase.

1.9 Distance Contracts

Purchases made through the website generally constitute distance contracts. Required information concerning the merchant, product or service, price, fees, delivery or performance, and applicable terms must be provided before the contract is entered into. Cancellation rights provided under Quebec’s Consumer Protection Act remain applicable where circumstances covered by that legislation arise.
